Terms & Conditions

• I understand that diving with compressed air involves certain risks: decompression sickness, embolism, or other hyper baric injuries can occur that require treatment in a recompression chamber. I further understand that the open water diving trips, which are necessary for dive trips, diver training and for certification, may be conducted at a site that is remote, either by distance or time or both, from a scuba recompression chamber. I still choose to proceed with such organised and/or instructional dives in spite of the possible absence of a recompression chamber in proximity to the dive site.
• I agree that neither CYDIVE Ltd or any of the employed Instructors, Dive Masters and Dive Guides or any other respective employees, officers, agents or assigns, (herein after referred to as the "Released Parties") may be held liable or responsible in any way for any injury, death, or other damages to me or my family, heirs or assigns that may occur as a result of my participation in diving trips, diving courses or as a result of negligence by any party, including the released parties, whether passive or active.
• In consideration of being allowed enrolling in these activities, I hereby personally assume all risks in connection with said activities, for any harm, injury or damage that may befall me while I am enrolled as a diver or a student in these activities including all risks connected therewith, whether foreseen or unforeseen.
• I further save and hold harmless said activities and Released Parties from any claim or lawsuit by me, my family, estate, heirs, or assigns, iridising out of my enrolment or participation in this activity including both claims arising during the activity or after.
• I also understand that skin diving and scuba diving are physically strenuous activities and that I will be exerting myself during these diving activities and that if I am injured as a result of a heart attack, panic, hyperventilation, etc. that I expressly assume the risk of said injuries and that I will not hold the above listed individuals, or company, responsible for the same. The following illnesses exclude a participation in diving courses and diving trips: Epilepsy - Cardiac defect - Tuberculosis - circulatory distress - illness of the respiratory system - illness of the nose and Para nasals - kidney- & gall stones - chronic eye disease - illness of the lungs. The participant states that he/she does not suffer any of these illnesses and that he/she also doesn't know of any other illnesses, which do not allow sport diving. The participation in diving is also not allowed for people who are drug- or medicine addicts.
• The participant states that he/she knows how to swim.
• Rented Equipment is to be returned rinsed in fresh water. Payment will be required for damaged or missing equipment.
• CYDIVE or any of its employees are not liable for loss, damage or theft of diving equipment or any other personal belongings left on the premises of the dive centre.
• Diving is not allowed 12/18/24 hours prior to flying.
• The diving programs can be changed without any notice in case of changing weather conditions, technical problems, or low number of participants.
• To put your name down for a diving trip or a diving course is equal to a reservation. The diving trips have to be paid in advance.
• I further state that I am of lawful age and legally competent to sign these Terms & Conditions, or that I have acquired the written consent of my parent or guardian.
• I understand that the terms & conditions are contractual and not a mere recital, and that I have signed this document of my own free act. I affirm that this release is binding for all claims, including but not limited to, those claims in tort and contract.
